SELAS FEATURED ("SELAS," "we," "us," "our") provides city-based social media pages, a companion website, and related services (together, the "Service") that spotlight selected individuals to audiences we build. SELAS is currently an early, invite-limited pilot. No company has been formally registered to operate it yet; these Terms are offered by the individual(s) building SELAS, and will be updated to name a registered company once one exists. These Terms of Service ("Terms") govern your use of the Service, including our Instagram and Facebook pages, our website, and any application or communication associated with SELAS.
By applying to SELAS, browsing a SELAS page, or otherwise using the Service, you agree to these Terms.
We're putting this early because it's the most important thing to understand about the Service.
SELAS is a media and spotlight service. We review applications, select individuals to feature ("Members"), and publish curated content about them to audiences we build on social media and our website. That's the entire service we sell. As a binding description of how the Service actually operates:
Any interaction, communication, or connection that develops after a feature is published is solely between the individuals involved. SELAS is not a party to it, does not monitor it, and assumes no responsibility for it. See Section 11.
You must be at least 18 to access or use the Service in any capacity. Featured Membership specifically requires that you be at least 25 years old at the time of application. By applying, you represent that all information you provide is accurate and that you meet these requirements.
We may request proof of age or identity at any time and may remove any user we reasonably believe does not meet these requirements.
Submitting an application does not guarantee selection. Selection is at SELAS's sole discretion, based on criteria that may change at any time without notice. We may decline, delay, or revoke a selection for any reason.
Application information beyond what appears in a published feature (including your legal name, contact details, occupation, and industry) is used internally for review purposes only and is never published. See our Privacy Policy for exactly what is and is not made public.
When you submit photos, written statements, or other material ("Submitted Content") as part of an application or as a Member, you represent that:
(a) you own the rights to it, or have permission to submit it;
(b) it depicts you, and no one else who hasn't separately consented;
(c) it does not infringe any third party's rights.
If selected, you grant SELAS a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, format for platform requirements, publish, and display the specific portions of your Submitted Content incorporated into your published feature. This license covers our social media pages, our website, and directly related promotional material, for as long as you remain a Member and subject to your removal rights below.
This license also serves as your express written consent, under Florida Statute § 540.08 and equivalent publicity-rights laws in other states, to SELAS's commercial use of your name, likeness, photograph, and biographical statements as incorporated into your published feature, and to no other use.
You may request removal of your feature and Submitted Content at any time. We will remove published features within 48 hours of a verified request.
During the current pilot, SELAS charges no fees. This section describes how billing will work once a paid tier launches; until then, it doesn't apply.
Certain aspects of the Service require a subscription fee, disclosed clearly before you pay. Founding Members in a given city may receive a complimentary introductory period, publicized at the time.
Billing. Subscriptions renew automatically at the then-current rate until cancelled. We will disclose price and billing frequency before you subscribe, and will not condition your subscription on anything not disclosed at that time.
Cancellation. You may cancel at any time, through the same channel you used to subscribe, with no more steps than it took to sign up. Cancellation takes effect at the end of the current billing period. We do not offer partial-period refunds except where required by law.
No outcome-based fees. Consistent with Section 2, fees are for the visibility service described here, never for any particular outcome.
Published features identify Members only by a first name or an assigned Feature identifier, together with age and general area. We never publish a Member's full legal name, Instagram handle, employer, or income. This is a contractual commitment: SELAS will not publish a Member's full legal name under any circumstance without separate, explicit written consent.
You agree not to:
Violating this section may result in immediate removal from the Service, forfeiture of prepaid fees, and, where appropriate, referral to law enforcement. We actively moderate the Service to prevent misuse, including any use that could facilitate commercial sexual solicitation.
We may remove any Member, applicant, comment, or content, and may suspend or terminate access to the Service, at our discretion, with or without notice, for any reason including a suspected Terms violation.
The Service operates in part on Instagram and Facebook, both operated by Meta Platforms, Inc. Your use of those platforms is separately governed by Meta's own terms, which we don't control. We're not responsible for the availability, features, or policies of any third-party platform.
If you communicate with or meet another individual as a result of anything you saw on the Service, you do so entirely at your own risk. SELAS does not conduct criminal background checks on applicants or Members unless we state otherwise in writing for a specific offering, and cannot guarantee any individual's conduct, intentions, or safety. If you arrange to meet someone you learned about through the Service, we encourage the same caution you'd use meeting any stranger: meet in public, tell a friend where you're going, and trust your judgment.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY FEATURE WILL RESULT IN ANY PARTICULAR LEVEL OF ATTENTION, RESPONSE, OR OUTCOME.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELAS AND ITS OFFICERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR ANY INTERACTION WITH ANOTHER USER. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO SELAS IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
You agree to indemnify and hold SELAS harmless from any claim, including reasonable attorneys' fees, arising from your Submitted Content, your violation of these Terms, or your interactions with any other individual in connection with the Service.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Agreement to Arbitrate. You and SELAS agree to resolve any dispute arising from these Terms or the Service through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court. YOU AND SELAS EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
Opt-Out. You may opt out of this arbitration agreement by submitting written notice through our contact form within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to jurisdiction there.
If you believe content on the Service infringes your copyright, contact us through our contact form.
We may update these Terms from time to time, posting the revised version with a new "Last Updated" date. Continued use after changes take effect means you accept them.
We may suspend or terminate your access at any time, for any reason, including a Terms violation. Sections 2, 7, 11 through 15, and any provision that by its nature should survive, will survive termination.
